Whatcom Artist Studio Tour Member Artist Consent and Waiver Form 

Whatcom Artist Studio Tour (WAST) recommends that all member artists acquire insurance to cover their participation in WAST events. 

Release and Waiver of Liability 

This Release and Waiver of Liability (The “Release”) is executed by the undersigned (The “Participant”), and Whatcom Artist Studio Tour, its affiliates members, managers and employees (collectively “Whatcom Artist Studio Tour”) with regard to exhibits, demonstrations and other events organized by Whatcom Artist Studio Tour, and attended by Participant and/or Participant’s minor children, and/or minor children under direct supervision of Participant. The Participant does hereby freely, voluntarily, and without duress execute this Release under the following terms:

1. Waiver and Release Participant does hereby release and forever discharge and hold harmless Whatcom Artist Studio Tour and its successors and assigns from any and all liability claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from Participants, and/or participant’s minor children’s, involvement in activities hosted, organized or involving Whatcom Artist Studio Tour. Participant understands and acknowledges that this Release discharges Whatcom Artist Studio Tour, from any liability or claim that the Participant may have against Whatcom Artist Studio Tour with respect to any accident, bodily injury, personal injury, illness, or property damage that may result from Participants involvement.

2. Assumption of the Risk Participant recognizes and understands that there may be inherent risk with regard to Participant’s involvement. Participant understands and acknowledges that this Release discharges Whatcom Artist Studio Tour from injury, illness, accident, or property damage resulting from participation in any event associated with Whatcom Artist Studio Tour.

3. Insurance The Participant understands that insurance for liability, health, and medical or disability coverage in any way related to this event and under this agreement is the sole responsibility of Participant.

4. Indemnification Participant agrees that he/she will indemnify and hold Whatcom Artist Studio Tour harmless from any liability resulting from involvement in this event by Participant, his/hers assigns, heirs, guests, invites or other persons accompanying Participant.​

5. Other Participant expressly agrees that this Release is intended to be as broad and inclusive as permitted by laws of the State of Washington and that this Release shall be governed by and interpreted in accordance with the laws of the State of Washington. Participant agrees that in the event that any clause or provision is determined to be or to have become invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions of the contract shall not in any way be affected or impaired.

6. Photography/AudioRelease I do hereby grant and convey unto Whatcom Artist Studio Tour all right, title and interest in and to any and all photographic images and video recordings made by or on behalf of the Whatcom Artist Studio Tour, or made with its consent during my participation in the Whatcom Artist Studio Tour and/or any project, activity or event sponsored, managed, arranged or promoted by, or otherwise affiliated with the Whatcom Artist Studio Tour, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.
